RENTAL CONDITIONS

• OBJECT

The essential object of this contract is the rental of the vessel owned by you as indicated in the Particular Conditions, in suitable navigable conditions for exclusive use in sports and recreational navigation, according to the terms and conditions agreed by the parties in this contract.

• LEASE TERM

The TENANT/CLIENT rents the referenced vessel for the maximum duration specified in the Particular Conditions.

This period may be extended with the explicit written consent of both parties.

A delay in the retrieval of the vessel by the TENANT/CLIENT, due to their own fault, will not result in an extension of the rental term.

A delay in returning the vessel by the TENANT/CLIENT to its home port will entitle the LESSOR/SAILWAY S.L to retain the deposit and demand payment from the tenant as stipulated in the Clause

• PICK-UP AND DELIVERY LOCATION

The vessel will be delivered to the TENANT/CLIENT at the port and time specified in this contract. The vessel will be insured, ready to sail, with all equipment onboard and the water, fuel, and gas tanks full.

If adverse weather conditions require the TENANT/CLIENT to delay their initial or subsequent departures, there will be no reduction in price, nor an extension of the stipulated period, both established in this document, unless expressly agreed by both parties.

Before delivery of the vessel, both parties shall inspect the vessel and sign the CHECK IN (inventory). Once completed, the Tenant will sign the CHECK IN (inventory) indicating their approval. Acceptance of the boat and signing of the inventory imply that it is in good condition and that the Tenant agrees to the terms of this contract.

The vessel must be returned to the Lessor within the timeframe set forth in the Particular Conditions of this contract and as specified in the Clause

• DEPOSIT

The Tenant must deliver to LESSOR/SAILWAY S.L the amount specified in the Particular Conditions as a deposit.

THE TENANT/CLIENT shall provide, at the time of signing the contract, the amount described in the Particular Conditions as a DEPOSIT. The DEPOSIT will be charged to a VISA credit card to guarantee compliance with the obligations contained in this contract. This amount will be refunded to the TENANT/CLIENT once the lease contract has concluded and SAILWAY has verified the condition of the vessel as well as the compliance with the tenant's obligations. For this, it may be necessary to retain the deposit for up to a maximum of 7 days after the vessel is returned. The LESSOR/SAILWAY S.L is responsible for any damages, losses, or breakdowns that occur, both to the rented vessel and any of its auxiliary elements such as the dinghy, as well as everything inventoried and verified in the document signed by both parties during "Check in-out." Should any of the aforementioned circumstances arise or there be a delay in the scheduled return, the LESSOR/SAILWAY S.L will retain and apply the deposit to compensate for the damages or losses incurred, both material and otherwise. The TENANT/CLIENT will pay the full amount of the deposit according to the invoices for the damages, losses, or repairs as determined by Sailway and their corresponding labor costs.

The TENANT/CLIENT must immediately notify the LESSOR/SAILWAY S.L of any accident, incident, breakdown, or issue regardless of its nature. FAILURE TO INFORM IMMEDIATELY WILL RESULT IN THE CLIENT LOSING THE ENTIRE DEPOSIT DUE TO A SERIOUS BREACH OF CONTRACT. In the case of an accident, a written accident report must be formalized, detailing the causes, circumstances, and consequences of the incident, as well as, if known, the name, surname, and address of the individual responsible for the incident and witnesses, along with the names and addresses of affected parties if applicable. An accident, for the purposes of this contract, is defined as any fortuitous, spontaneous, external, or violent event.

• CONCEPTS EXCLUDED FROM RENTAL PRICE

The price of the contract does not include fuel consumption or stays at any port other than the vessel’s home port, which will always be at the TENANT/CLIENT's expense.

FUEL. The TENANT/CLIENT must return the vessel to LESSOR/SAILWAY S.L with a full fuel tank and it is mandatory to provide the fuel station receipt to Sailway staff at the time of check-out. Failure to refuel will result in the total amount consumed being deducted from the deposit, plus a penalty of 50€ + VAT for breach of contract.
