Boat Conditions

  • 17. Crew
  • a) The Owner shall provide a qualified Captain in accordance with the requirements of the vessel's flag state and acceptable to the insurers, along with an adequately trained and certified Crew. No Crew member shall carry illegal drugs or firearms onboard the Vessel. The Captain and the Crew shall at all times comply with the applicable laws and regulations of any country whose waters are navigated during the term of this Agreement.
  • b) It is acknowledged that the Crew has the right to the minimum rest periods established in the Vessel's Codes of Practice, including, but not limited to, the provisions of the Maritime Labor Convention (MLC) 2006.
  • c) The Captain and the Crew shall be obliged at all times to maintain strict confidentiality regarding all information related to this Charter, the Owner, the Client, and all Guests, and shall not disclose such information to third parties without the prior written consent of the Client, except when legally required.
  • 18. Advance Provisioning Allowance (APA)
  • Once the Client has paid the Advance Provisioning Allowance (APA) into the Broker's account, the Captain will periodically inform the Client about the expenditures made against the APA. Should the remaining balance be insufficient to cover the anticipated costs, duly justified by receipts, the Client shall transfer the additional funds necessary to the Captain to maintain an adequate balance.
  • The Owner will ensure that the Captain exercises due diligence in managing the APA. All expenses and commissions resulting from the transfer of the APA to the Vessel shall be borne by the Client. Exchange rates, when applicable, cannot be guaranteed.
  • Before disembarking at the end of the Charter Period, the Captain will present the Client with a detailed account of expenses, accompanied by as many receipts as possible. The Client shall settle any outstanding balance, or alternatively, the Captain will reimburse the Client for any amount overpaid. Any amount of the APA pending reimbursement to the Client will be returned by the Central Agency within a maximum of seven (7) days after the conclusion of the Charter Period by bank transfer. All costs and commissions arising from such reimbursement will be the responsibility of the Client.
  • Charged to the APA, the Client will pay at cost all expenses related to the Charter, including, but not limited to: final cleaning of the Vessel after the Charter; laundry of bed linens and towels; land transport; fuel for main engines and generators; fuel for tenders and water sports equipment; food and beverages for the Charter Group and Crew; mooring fees and port charges, pilot fees, local taxes, diver fees, customs procedures, waste management and disposal, supply of water and electricity from ashore; fees for maritime agents where applicable; personal laundry; communications and internet for the Charter Group; as well as rental or purchase of special equipment requested by the Client.
  • 19. Special Conditions
  • The Vessel is anchored or moored to a buoy. Both boarding (check-in) and disembarking (check-out) will be carried out using the tender (dinghy).
  • Smoking is strictly prohibited in the interior spaces of the Vessel.
  • No pets are allowed onboard.
  • Minors must be under the direct supervision of the Charter Group at all times.
  • Moorings are not guaranteed.
  • All payments must be received in full and without deductions. Any bank charges resulting from transfers will be deducted from the APA.
  • The APA will be settled onboard before the Client disembarks.
  • In case of changes to applicable tax regulations, including VAT, the Client will fully bear any additional costs resulting from such changes.
  • Tipping the Crew is customary, at the Client's discretion, and is not included in the Charter Price.
